Bond revoked for defendant accused of shooting at Ellerbe firefighters

ROCKINGHAM — A local businessman accused of shooting at two Ellerbe firemen is back in jail after a judge has revoked his bond.

Records show Superior Court Judge Alicia Marks Flowers revoked the bond of Timothy Lee Hayden on March 4. Hayden was booked into the Richmond County Jail at 11:03 a.m. and is being held without bond.

Assistant District Attorney Alex Harris filed a motion to revoke the bond on Feb. 17, alleging that Hayden missed two breath tests to check his blood alcohol level.

As a condition of his release, Hayden was ordered to abstain from drinking alcohol and initially outfitted with a continuous alcohol monitoring system. He was also prohibited from having contact with the reported victims and from possessing firearms.

However, records show that Superior Court Judge James Hill, on Dec. 4, switched Hayden to a portable breathalyzer after the defendant had a “rare” allergic reaction to trace amounts of nickel in the faceplate of the original system.

Hill ordered that Hayden be tested twice a day — at 9 a.m. and 9 p.m. — seven days a week. Court documents show Hayden had a 30-minute testing window.

Documents including in Harris’ motion show that Hayden missed tests on Jan. 14 and Feb. 7.

According to the report from SCRAM Systems, Hayden told the provider in January that he had forgotten to test while he was on the way to an Alcoholics Anonymous meeting.

The report reads: “Client informed provider at 0903 that he was in traffic and did not believe he could get to his device by 0930 deadline. Client advised to try his best. Client attempted to test at 0933 but was locked out for missing testing window. Due to provider's schedule On Demand test could not be initiated until 1335. Client received text notification for On Demand test at 1338 and was permitted to test at 1341. Client's result for On Demand test BrAC 0.000. It is highly unlikely that client had alcohol in his system at the time of the testing window based on results from On Demand test.”

Likewise, the notes for missing the February test indicate that Hayden said he was on his way to an AA meeting in Sanford with a friend and missed the 30-minute window.

Hayden is accused of firing multiple rounds from an AR-15-style rifle at Jeremy Scott and Jerry Shepard who were reportedly responding to a fire alarm at his Green Lake Road home just before 3:30 a.m. on Sept. 1. Shepard was shot in the leg, documents show.

He was initially charged with two wascounts of assault on emergency personnel with a firearm, and one count each of assault with a deadly weapon with intent to kill inflicting serious injury, assault with a deadly weapon with intent to kill and resisting a public officer.

Both Scott and Shepard were awarded for their bravery during a community prayer and recognition event in Ellerbe Sept. 6.

Hayden was granted bond following a Sept. 9 hearing and several properties were listed for accomadation.

On Sept. 15, records show, Hayden was indicted on the two counts of assault on emergency personnel with a firearm and the charge of assault with a deadly weapon with intent to kill inflicting serious injury.

A few days later, on Sept. 22, Hayden was indicted on two counts of attempted first-degree murder.

Court records show Hayden had a hearing scheduled for April 6, but that date has been labeled as “cancelled.”

All defendants facing criminal charges are presumed innocent until proven guilty in a court of law.
